Terms of sale and service
These terms apply when you use our public site, design tools, checkout, or an organization store, and when Blue Moose Designs accepts your order for products or services.
1. Who we are and when these terms apply
Blue Moose Designs, LLC, doing business as Blue Moose Designs, is an Anchorage, Alaska custom decoration, printing, and fabrication business. In these terms, “Blue Moose,” “we,” “us,” and “our” mean Blue Moose Designs, LLC; “you” means the visitor, customer, or person authorized to place an order for an organization.
By using the site or submitting an order, you agree to these terms and the policies linked from our legal and policy center. If you place an order for a business, school, team, nonprofit, or other organization, you confirm that you are authorized to act for it. An individual placing an order must be at least 18 years old.
This site and its online ordering are directed to customers in the United States. We do not market or solicit orders through this site in the European Union or European Economic Area. Access from another location does not itself mean we offer products or services there. International work is accepted only when a written quote expressly says so, and rights that applicable law makes nonwaivable still apply.
2. Quotes, product information, and order acceptance
- A website listing, cart, estimate, or quote request is not our acceptance of an order. An order is accepted when we confirm it, accept payment where required, and any required proof or specifications are approved.
- Prices, taxes, shipping charges, allowances, and other adjustments are those shown at checkout or in the written quote that applies to the order. Obvious listing or calculation errors may be corrected before production, with notice and an opportunity to approve the correction or cancel the affected order.
- Product colors, inventory, sizes, materials, and supplier availability can change. We will not make a material substitution without your approval.
- A requested date is a request, not a commitment. A person confirms whether the job can be scheduled for that date after the artwork, product, quantity, and production method are known.
3. Custom work, proofs, and customer instructions
You are responsible for checking names, spelling, numbers, sizes, quantities, colors, product selections, placement, and other order details before approval. A digital proof shows content and general placement; screens, materials, inks, threads, coatings, and production processes can create reasonable differences from a display.
Approval authorizes us to produce the work as approved. A change requested after approval may require a revised quote, proof, materials, or schedule. More detail appears in our custom work and supplied items policy.
A change order must be submitted in writing by email or text message and is not accepted until Blue Moose confirms it in writing.
4. Artwork and intellectual property
You keep ownership of artwork and marks you already own. You give us a limited license to copy, resize, convert, adapt, and use submitted files only as reasonably needed to quote, proof, produce, deliver, support, and keep records of your order.
You confirm that you own the submitted material or have written permission to use it. We may refuse, pause, or cancel work that may violate another person’s copyright, trademark, publicity, privacy, or other rights. Our full rules are in the artwork and intellectual property policy.
5. Customer-supplied products and materials
We accept customer-supplied garments, products, and materials only from contract clients. Retail clients need prior manager approval. Acceptance is discretionary, a signed customer-supplied-item waiver or written order terms are required before intake, and each item is provided at the customer’s sole risk. To the fullest extent permitted by law, the customer assumes the risks of loss, third-party theft, damage, destruction, defects, and production reactions and waives related claims and damages, including claims alleging ordinary negligence. The waiver does not apply to gross negligence, willful misconduct, or liability that applicable law does not permit the customer to waive. Additional details are in our custom work and supplied items policy.
6. Organization stores and member access
An organization may select products, artwork, access rules, allowances, and store dates under a separate agreement with Blue Moose. The organization is responsible for the accuracy of information it supplies and for distributing any private access code only to eligible members. We may limit or revoke access when needed to protect the store or comply with the organization’s written instructions.
Allowances and sponsor-funded amounts apply only as shown in the store and have no cash value to the shopper. Fundraising proceeds, organizer reporting, and store administration are governed by the organization’s agreement with us; they do not change a shopper’s rights for an individual order.
7. Payment and fraud prevention
Orders are 100% prepaid unless Blue Moose discusses and approves different terms in writing. A quote, invoice, or other written order record will identify any approved exception.
Card payments are completed on a Stripe-hosted page. Blue Moose does not receive the full card number or security code. We and our payment provider may decline, hold, or cancel a transaction when reasonably necessary to address suspected fraud, duplicate activity, sanctions, or an authorization problem. Invoice terms, when used, appear on the invoice or written quote.
If a chargeback is filed and the amount remains validly owed after the chargeback is resolved, Blue Moose may add an administrative chargeback fee equal to 10% of the order value or $25, whichever is greater, capped at $100, to the extent permitted by law. The account will be placed on hold, and no new order or job will be processed, until the chargeback issue and associated permitted fees are cleared.
8. Shipping, pickup, returns, and order concerns
Our shipping and pickup policy explains address checks, carrier delays, pickup, and damaged or missing packages. Our returns and remedies policy explains custom products, cancellations, defects, Blue Moose errors, and the information we need to review a concern.
Nothing in these terms limits a right or remedy that cannot lawfully be limited. If a shipment is delayed, we will provide the notice and choices required by applicable law.
9. Acceptable use of the site
You may not use the site to:
- break a law, infringe another person’s rights, or submit unlawful material;
- probe, bypass, disable, or interfere with a security or access control;
- upload malicious code or use automated traffic that disrupts the service;
- misrepresent your identity, authority, eligibility, or payment information; or
- copy, scrape, or reuse site content or production resources except as law allows.
We may restrict access or cancel a request that violates this section.
10. Blue Moose materials and production resources
The site, Blue Moose branding, templates, software, production methods, shop files, jigs, toolpaths, digitizing, separations, and other internal production resources belong to Blue Moose or its licensors unless a written agreement says otherwise. Buying a finished product does not transfer those resources. Customer-owned marks and customer-supplied artwork remain the customer’s property.
11. Disclaimers and limits of liability
We will perform accepted services in a professional and workmanlike manner. Except for express written commitments and rights that cannot be excluded, the site and services are provided without other warranties, including implied warranties of merchantability, fitness for a particular purpose, and noninfringement.
To the fullest extent permitted by law, Blue Moose is not liable for indirect, incidental, special, exemplary, or consequential loss, including lost profits or lost opportunity. Our total liability arising from an order will not exceed the amount paid to Blue Moose for the affected part of that order. These limits do not apply where prohibited by law or to liability caused by fraud, willful misconduct, or another category that cannot lawfully be limited.
12. Your responsibility for rights violations
To the extent permitted by law, you will defend and reimburse Blue Moose for a third-party claim, loss, or reasonable cost caused by artwork, instructions, materials, or conduct you supplied in breach of these terms. This does not apply to a claim caused by Blue Moose’s unauthorized change or use outside the accepted order.
13. Governing law and disputes
Alaska law governs these terms without regard to conflict-of-law rules. Any court action must be brought in a state or federal court with jurisdiction in Anchorage, Alaska, unless applicable consumer law gives you another right. Before filing, we ask both sides to give the other a fair opportunity to review the problem and supporting records.
14. Changes, severability, and complete agreement
We may update these terms prospectively by posting a new effective date. The terms in effect when an order is accepted continue to govern that order unless a change is required by law or both sides agree in writing. If one provision is unenforceable, the remaining provisions stay in effect. A failure to enforce a provision once is not a waiver.
These terms, the linked policies, and the accepted quote, proof, or order document form the agreement for the transaction. A more specific written order term controls over a general term here for that order.
